Track Star Terms of Service

Welcome to Track Star.
These Terms of Service (“Terms”) govern your access to and use of the Track Star website, applications, features, content, and related products and services (collectively, the “Service”).
The Service is operated by Public Opinion Corporation (“Track Star,” “we,” “us,” or “our”).
By creating an account or otherwise accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Track Star is a social platform for discovering, rating, reviewing, organizing, and discussing music.
Among other features, the Service may allow users to:
- Rate Albums
- Write Reviews and Review replies
- Identify Standout tracks
- Create profiles
- Build a Shelf and arrange a Top 5
- Save Albums to a private Saved collection
- Submit Picks to Lists
- Like Reviews and interact with other content
- Follow or discover other members
- View community Ratings and activity
- Discover Albums, Artists, and tracks
We may add, remove, modify, suspend, or discontinue any portion of the Service at any time.
2. Eligibility
You must be at least 13 years old to use Track Star.
If you are under the age of majority where you live, you represent that you have permission from your parent or legal guardian to use the Service.
You may not use the Service if applicable law prohibits you from doing so.
3. Accounts
Certain features require you to create an account.
You agree to provide accurate information and keep your account information reasonably current.
Track Star signs you in with a single-use link sent to your email address. Access to that email account is access to your Track Star account, so you are responsible for keeping your email account secure and for activity occurring through your account.
You may not:
- Create an account using another person’s identity without permission
- Impersonate another person or organization
- Sell, transfer, or otherwise provide your account to another person without our permission
- Access another user’s account without authorization
- Use the Service after we have suspended or terminated your account without our permission
Please notify us if you believe your account has been compromised.
4. Ratings, Reviews, and User Content
Track Star allows members to submit Ratings, Reviews, Review replies, Picks, profile information, Standout tracks, and other materials (“User Content”).
You retain ownership of User Content you create.
However, by submitting User Content through the Service, you grant Track Star a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, publish, distribute, modify, format, and otherwise use that User Content as reasonably necessary to operate, promote, improve, and provide the Service.
This license includes the ability to display your User Content to other users and through Track Star’s websites, social channels, promotional materials, or other Track Star products, subject to applicable law.
You represent that:
- You own your User Content or have the necessary rights to submit it
- Your User Content does not violate another person’s intellectual property, privacy, publicity, or other rights
- Your User Content does not violate applicable law
- Your ratings and reviews reflect your genuine opinions
Ratings and Reviews submitted by members represent the opinions of those members. They do not necessarily represent the views of Track Star or Public Opinion Corporation.
5. Public Content
Track Star is designed around sharing music tastes and opinions.
Unless a feature is expressly identified as private, you should assume that information you post through your profile, Ratings, Reviews, Picks, Review likes, and similar social features may be publicly visible.
Other members may view, interact with, or share links to publicly available User Content.
Do not submit information you do not want others to see.
6. Community Rules
We want Track Star to be a place where people can disagree about music without abusing each other.
You may not use the Service to post, upload, transmit, or otherwise distribute content that:
- Is unlawful, fraudulent, threatening, or deceptive
- Harasses, threatens, stalks, or abuses another person
- Promotes hatred or violence against individuals or groups
- Contains unlawful sexually explicit material
- Exploits or endangers minors
- Violates another person’s privacy or publicity rights
- Infringes copyright, trademark, or other intellectual property rights
- Contains malware, viruses, or harmful code
- Constitutes spam, unauthorized advertising, or mass solicitation
- Is intentionally manipulated to artificially affect ratings, rankings, likes, or other metrics
- Impersonates another person or falsely suggests an affiliation with another person or organization
- Otherwise interferes with the safe and normal operation of Track Star
Music opinions can be strong. Disliking an album is not, by itself, a violation of these Terms.

7. Rating Manipulation
You may not attempt to artificially manipulate Track Star ratings, rankings, popularity, likes, or other community metrics.
Prohibited activity includes:
- Creating multiple accounts for the purpose of manipulating scores
- Using bots or automated systems to submit ratings or interactions
- Coordinating fraudulent rating campaigns
- Buying or selling ratings, likes, followers, or other engagement
- Attempting to circumvent systems designed to protect the integrity of Track Star ratings
We may remove ratings or other activity that we reasonably believe is fraudulent, automated, coordinated, or otherwise inconsistent with these Terms.
8. Moderation
We may, but are not obligated to, monitor or review User Content.
We reserve the right to remove, restrict, hide, or disable access to User Content that we believe violates these Terms, our policies, applicable law, or the rights or safety of others.
We may also suspend or terminate accounts or restrict access to the Service.
We are not responsible for User Content posted by users, and we do not necessarily endorse or verify statements, ratings, opinions, or recommendations appearing on the Service.
9. Intellectual Property
Except for User Content and materials owned by third parties, Track Star and its licensors own the Service and its associated software, design, graphics, logos, branding, interfaces, text, features, compilations, and other materials.
The Track Star name, logos, designs, and related marks are owned by or licensed to Public Opinion Corporation.
These Terms do not grant you ownership of any Track Star intellectual property.
You may use the Service only for your personal, non-commercial use unless we expressly authorize otherwise.
10. Music, Album Artwork, and Third-Party Content
The Service may contain names, images, album artwork, artist information, song titles, music metadata, trademarks, and other materials owned by artists, record labels, publishers, distributors, streaming platforms, data providers, or other third parties.
Ownership of those materials remains with their respective owners.
The appearance of music, artists, albums, trademarks, artwork, or other third-party materials on Track Star does not imply sponsorship, endorsement, or affiliation unless expressly stated.
11. Copyright
We respect intellectual property rights.
If you believe content available through Track Star infringes your copyright, please contact us at dmca@publicopinion.nyc with sufficient information for us to identify the work, locate the allegedly infringing material, and understand the basis of your claim.
We may remove or disable access to content when appropriate and may terminate accounts of repeat infringers where required or appropriate.
12. Prohibited Use
In addition to the restrictions above, you may not:
- Use the Service for unlawful purposes
- Attempt to gain unauthorized access to the Service, another account, or related systems
- Interfere with or disrupt the Service or its infrastructure
- Introduce malware or malicious code
- Circumvent security or access controls
- Scrape, crawl, harvest, copy, or systematically extract data from the Service without our written permission
- Use bots, scripts, or automated systems to interact with the Service without authorization
- Reverse engineer or attempt to derive source code from the Service except where applicable law expressly permits it
- Use Track Star content or data to build or train a competing service, database, model, or product without our written permission
- Use the Service in a manner that places an unreasonable burden on our infrastructure
- Assist another person in doing any of the above
We may implement technical measures to prevent prohibited activity.
13. Third-Party Services
Track Star may contain links to or integrations with third-party websites, music services, platforms, or applications.
We do not control and are not responsible for third-party services, including their availability, content, security, or privacy practices.
Your use of third-party services is governed by their own terms and policies.
14. Feedback
If you send us suggestions, ideas, feedback, or recommendations regarding Track Star, you grant us the right to use that feedback without restriction or compensation to you.
15. Termination
You may stop using Track Star at any time, and you may delete your account from Settings.
We may suspend, restrict, or terminate your access to all or part of the Service if:
- You violate these Terms
- Your activity creates risk or potential legal exposure for us or others
- We reasonably believe your account is being used fraudulently or unlawfully
- Doing so is necessary to protect Track Star, our users, or third parties
- We discontinue the Service
Where appropriate, we may provide notice before terminating an account, but we are not required to do so in all circumstances.
Sections of these Terms that by their nature should survive termination will remain in effect.
16. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TRACK STAR AND PUBLIC OPINION CORPORATION DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE
- INFORMATION ON THE SERVICE WILL ALWAYS BE ACCURATE OR COMPLETE
- RATINGS, REVIEWS, RECOMMENDATIONS, OR OTHER USER CONTENT WILL BE ACCURATE OR RELIABLE
- DEFECTS WILL ALWAYS BE CORRECTED
YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACK STAR, PUBLIC OPINION CORPORATION, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Public Opinion Corporation and its affiliates, officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from or relating to:
- Your violation of these Terms
- Your User Content
- Your misuse of the Service
- Your violation of applicable law or another person’s rights
19. Governing Law
These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws of the State of New York, without regard to conflict-of-laws principles.
You agree that disputes may be brought in the state or federal courts located in New York County, New York.
20. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the “Last Updated” date above. If changes are material, we may provide additional notice.
Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
If you do not agree to updated Terms, you should stop using the Service.
21. General Terms
These Terms, together with our Privacy Policy and any additional terms presented through the Service, constitute the agreement between you and Public Opinion Corporation regarding your use of Track Star.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver of our right to do so later.
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or otherwise as permitted by law.
